Who can enter

  1. Entrants must:
    1. be 18 years old or over;
    2. be a resident of Australia;
    3. be the primary or secondary account holder of an active consumer Linkt Tag, Tagless, Prepaid or Postpaid Account;
    4. be a Linkt Rewards member; and
      be 'opted-in' to receive marketing and promotional communications from the Promoter and remain opted-in until the competition prize draw which will take place at 12PM AEDT, Thursday 10 October 2024
  2. The following persons are ineligible:
    1. LinktGO customers;
    2. Linkt Commercial Account holders or Linkt Commercial Rental Account holders;
    3. Pass holders;
    4. directors and management of the Promoter;
    5. officers, employees, and contingent workers of the Promoter, Queensland Motorways Management Pty Ltd and Sydney Motorway Corporation Pty Ltd; and/or 
    6. retailers, suppliers, associated companies, and agencies of the Promoter who are associated with this Promotion, and their directors, management and employees.
  3. The Promoter reserves the right to request verification of identity, residential address and any other information from any entrant or winner relevant to entry into, or participation in, the Promotion. Verification is at the discretion of the Promoter, whose decision is final.

How to enter

  1. To enter, an eligible individual must, during the Promotion Period:
    1. log in to their Linkt consumer account using the Linkt app;
    2. navigate to view the offers in the ‘Rewards’ tab in the Linkt app;
    3. if they have not already, join Linkt Rewards including accepting the Linkt Rewards Membership terms; and
    4. enter online at www.linkt.com.au/fly and:
      1. provide the email address that is listed on their Linkt account
      2. agree to the competition terms and conditions
      3. consent to receive Linkt promotional communications and remain opted-in until the competition prize draw which will take place at 12PM AEDT, Thursday 10 October 2024
      4. consent to the Promoter disclosing their full name, email address and/or mobile number to either Ignite Travel Group Ltd (Global Escapes) (First Prize winners) or Handling Matters Pty Ltd (Second Prize winners) for the purpose of prize fulfillment but only where they are a winner
      5. acknowledge they have read and understood the Privacy Policy
  2. Limit on number of entries
    An eligible customer can only enter the competition draw once. Where eligible customers share an account, each eligible customer may enter separately but only one Prize will be awarded per Linkt account.
  3. An entry must be received by the Promoter by the end of the Promotion Period, or it will not be accepted. Entries are deemed to be received at the time of receipt by the Promoter, not at the time of transmission by the entrant.
  4. The Promoter takes no responsibility should a person not have the software, hardware or mobile plan that permits access to, and use of, the method of entry. Any costs associated with accessing the internet, downloading data on a mobile device, or using any device to access and use the method of entry is the sole responsibility of the entrant and is dependent on the Internet/mobile service provider used.
  5. To the extent permitted by law, the Promoter accepts no responsibility for:
    1. any late, lost, or misdirected entries or other communications; or
    2. any internet traffic congestion or problems with, or technical malfunction of, any hardware or software, including but not limited to any damage to the hardware or software of any entrant or other persons related to participation in the Promotion.
  6. Entrants must not:
    1. tamper with the entry process;
    2. engage in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion;
    3. use multiple aliases, email addresses, postal addresses, PO Box addresses and/or SIM cards to register multiple qualifying accounts or use any form of software or third party application to enter multiple times (including scripting software) except where expressly permitted in these Terms; and
    4. engage in conduct in entering the Promotion which, in the opinion of Promoter, is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.
  7. The Promoter reserves the right to disqualify any individual who breaches these Terms, including but not limited to providing false information, failing to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering, or tampering with the Promotion.
  8. Entries remain the property of the Promoter.

  2. If a winner ceases to meet the eligibility requirements set out in paragraph 9 after entering the Promotion and before the Prize is delivered, the Prize will be forfeited by the winner and cash will not be awarded in lieu of the Prize.
  3. Unless expressly stated otherwise, prize values are:
    1. in Australian dollars; and
    2. based on the recommended retail prices at the time of first publication of these Terms (inclusive of GST). The Promoter accepts no responsibility for change in prize value between the time of first publication of these Terms and the ultimate prize redemption date.
  4. Prizes are not transferable, exchangeable and cannot be redeemed for cash. If a Prize or any element of a Prize is unavailable for any reason, the Promoter may substitute for that Prize, or an element of that Prize, another item of equal or higher value as determined by the Promoter (in its sole and absolute discretion).
  5. Tax implications may arise from the receipt or use of a Prize. Independent financial advice should be sought.

Prize specific terms

  1. General First Prize Terms
    1. First Prize winners will be notified by phone call and then emailed using the phone number and email address on their Linkt account. The winner will be provided with a unique Serial Number. The winner must book through Global Escapes by contacting reservations on 1300 850 151 and quoting the unique Serial Number.
    2. First Prize winners must book before 31 January 2025 and travel by 20 December 2025. All dates are subject to availability and blackout periods apply.
    3. The prize will expire if not booked or used by the dates set out in paragraph 22.b).
    4. Travel is valid for a maximum of two adults, unless otherwise stated, and one traveller must be the prize winner. 

    5. The following are not included as part of the holiday prize: all other out of pocket expenses including additional accommodation due to flight schedules, optional excursions, tipping, travel insurance and all other ancillary costs not expressly provided. The costs of obtaining any of these requirements are the responsibility of the prize winner and their travel companions.

    6. The winner is responsible for ensuring that the winner and travel companion have valid passports, if choosing international prizes (passports must be valid for at least six months from date of travel), and any requisite visas, vaccinations and travel documentation. Frequent flyer points will not form part of the prize.

    7. Airfares are based on the best available airfare at time of publication and are subject to availability and change. Flights may not be direct or operate daily, flights will be selected at time of booking based on the best available airfare at time of publication. Should the prize winner want flights different to those offered, additional charges will apply and will be at the prize winner’s cost. Air surcharges apply during Australian school holidays and other peak travel periods. All airfares are non-refundable.

    8. A strict no cancellation/amendment policy applies once booking has been made.

    9. All prizes are available at time of publication. In the event the originally quoted product is unavailable at the time of booking, the Promoter reserves the right, at its absolute discretion, to substitute the product with another of similar nature and equal value.

  2. Warwick, Fiji Specific Terms
    1. Subject to resort availability and blackout dates listed below:
      • 22 December 2024 – 10 January 2025;
      • 1 April 2025 – 30 May 2025;
      • 15 June 2025 – 31 August 2025;
      • 16 September 2025 – 15 October 2025;
    2. All Meals for both guests daily with Exclusive Restaurant Dining subject to the following conditions: Lunch: Daily one course lunch from Bula Brasserie. Dinner: 4 x Bula Brasserie Dinners; credit of F$75 per person for 1 x Pappagallo Dinner, 1 x Sazanami Dinner, 1 x Wicked Walu Dinner. Lunches and dinners include up to 1 soft drink per person per meal and exclude alcohol. No refunds or credits will be given for unused meals during stay, and these cannot be accumulated for credits or used towards beverages.
  3. Crystalbrook Riley, Cairns Specific Terms

    2. 2 children 11 years old or younger stay free when using existing bedding on the Crystalbrook family package .
    3. $150 Crystalbrook Cairns wine, dine, spa credit - this amount is to be credited to the guest’s room account on check-in and used towards food, beverage and spa treatments at all Crystalbrook Cairns properties, including Crystalbrook Bailey, Crystalbrook Riley and Crystalbrook Flynn. $150 Crystalbrook Cairns wine, dine, spa credit cannot be applied towards external third-party service providers e.g. tours.
    4. Full Day Outer Great Barrier Reef Cruise – includes morning & afternoon teas, 3 hours at Outer Barrier Reef platform, snorkelling equipment, hot & cold buffet lunch, eco reef talk, semi-submersible coral viewing, underwater observatory. An Environmental Management Charge of $6.50 is levied on all adults and children entering the Great Barrier Reef Marine Park. This charge is included in your tour. Please Note: Hotel transfers are not included. All passengers will be required to make their own way to the check-in location.
  4. Hyatt Regency, Phuket Specific Terms
    1. Subject to resort availability and blackout dates listed below:
      • 1 November 2024 – 15 April 2025;
      • 1 November 2025 – 20 December 2025;
    2. Daily breakfast, lunch and dinner – is at the Pool House Kitchen and daily drink (including cocktail or beer) is based on a set menu that will be provided to customers in advance by the resort at time of travel. Menus are not inclusive of items such as steak, lobster, fresh fish and shellfish. These items may be available at a surcharge which will be advised at the resort at time of ordering.
    3. Thai massage – must be booked on arrival to the resort, walk-ins are not permitted.
  5. Pays-enabled Prepaid Mastercard Specific Terms
    1. Second Prize winners will be sent an email with an activation code and instructions on how to access their Vault Pays-enabled Prepaid Mastercard. The winner downloads and opens the Vault Payment Solutions app, enters their mobile number and the activation code (contained in email). The winner then adds the Mastercard to their mobile wallet. Vault Pays-enabled Prepaid Mastercards can be used anywhere Mastercard is accepted. Any ancillary costs associated with redeeming the Vault Pays-enabled Prepaid Mastercard are not included, and the winner is responsible for ensuring they are able to download and activate the Vault Pays-enabled Prepaid Mastercard – no physical gift card will be provided.
    2. The Vault Pays-enabled Prepaid Mastercard must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the Vault Pays-enabled Prepaid Mastercard any unused balance will be forfeited. We will not give you notice prior to expiry. Card expiry and balance can be found on your mobile device in your digital wallet.
    3. The Vault Pays-enabled Prepaid Mastercard is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 pursuant to license by Mastercard. Prize Draw

  1. A draw will take place at 12PM AEDT, Thursday 10 October 2024 (the Draw Date) at Transurban Limited, Tower Five, Collins Square, 727 Collins Street, Docklands VIC 3008.
  2. On the Draw Date, the winners will be randomly drawn by an electronic draw process from all entries received during the Promotion Period. The first 5 valid entries drawn will each win a First Prize and the next 100 valid entries drawn will win a Second Prize.
  3. An independent scrutineer will be present to supervise the draw and will not be associated with the Promoter or otherwise involved in the conduct of the Promotion.
  4. Limit applies of one Prize per person and per Linkt account, even if two or more persons share that account.

How winners will be notified

  1. Each First Prize winner will be notified by phone call using the phone number on their Linkt account and then emailed using the email address on their Linkt account within 7 days of the Draw Date. First Prize winners must confirm acceptance of their Prize during the phone call or by reply email. The Promoter has engaged Global Escapes to assist in prize fulfilment. The winner will be provided with a unique Serial Number. The winner must book through Global Escapes by contacting reservations on 1300 850 151 and quoting the unique Serial Number.
  2. Second Prize winners will be notified by email using the email address on their Linkt account. Second Prize winners will receive their Prize via email within 7 days of the Draw Date. The email will include an activation code to redeem their $50 Vault Pays-enabled Prepaid Mastercard. The Promoter has engaged Handling Matters Pty Ltd (ABN 20 098 648 616) (Handling Matters) to assist in prize fulfilment.
  3. Prize winners will be notified on or before Thursday 17 October 2024.
  4. The Promoter will make all reasonable attempts to identify and contact all Prize winners.
  5. Each First Prize winner’s initial of their first name, surname and postcode will be published at www.linkt.com.au/win-choose-fly by Thursday 31 October 2024 for a minimum of 28 days.

Second chance draw

  1. Subject to applicable law, in the event that:
    1. a Prize winner cannot be identified or contacted on or before 5pm AEDT Monday 4 November 2024, despite all reasonable attempts to do so by the Promoter; or
    2. a Prize is unclaimed by that time for any other reason whatsoever (including because the winner has forfeited their right to the Prize, the winner does not accept and claim the Prize in accordance with paragraph 31 the winner or the winning entry does not comply with these Terms, or otherwise).
  2. the Promoter will conduct a second chance draw in order to determine a second chance winner (Second Chance Winner) for each unclaimed Prize. The second chance prize draw will be conducted in the same manner as the original Prize draw (subject to any written directions from a regulatory authority).
  3. If required, a second chance prize draw will take place at 12pm AEDT on Thursday 12 December 2024 at Transurban Limited, Tower Five, Collins Square, 727 Collins Street, Docklands VIC 3008.
  4. Each Second Chance Winner of a First Prize will be notified by phone call using the phone number on their Linkt account and then emailed using the email address on their Linkt account. Second Chance Winners of a First Prize must confirm acceptance of their Prize during the phone call or by reply email within 10 days of being notified they are a winner. The Promoter has engaged Global Escapes to assist in prize fulfilment. The winner will be provided with a unique Serial Number. The winner must book through Global Escapes by contacting reservations on 1300 850 151 and quoting the unique Serial Number.
  5. Each Second Chance Winner of a Second Prize will be notified by email from Handling Matters using the email address on their Linkt account. Second Chance Winners of a Second Prize will receive their Prize via email within 10 working days of the Draw Date. The email will include an activation code to redeem their $50 Vault Pays-enabled Prepaid Mastercard.
  6. Second Chance Winners will be notified on or before Monday 23 December 2024.
  7. If after a second chance draw any Prize remains unclaimed for any reason, the Promoter may dispose of the Prize as it sees fit (subject to any written directions from a regulatory authority).
  8. The decision of the Promoter is final and binding; no correspondence will be entered into.

Personal information

  1. Details from entries will be collected and used for the purpose of conducting the Promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the Promotion), for promotional purposes surrounding the Promotion, and as otherwise set out in the Terms.
  2. Details of Prize winners will be disclosed by the Promoter for the purpose of prize fulfilment:
    1. First Prize winner’s first name, last name, and mobile number will be disclosed to Global Escapes
    2. Second Prize winners’ first name, last name and email address will be disclosed to Handling Matters
  3. Entrants’ personal information will be handled in accordance with the Promoter’s privacy policy, available at https://www.linkt.com.au/legal/policies/transurban-privacy-policy.
  4. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter via email at privacy@transurban.com or phone at 13 33 31.

  5. By entering the Promotion, entrants acknowledge that they have read and understood how their information will be used and disclosed by the Promoter and that this use and disclosure will be without any further reference or payment to the entrants.

Governing law

  1. The agreement which comes into force under these Terms is governed by, and must be construed in accordance with, the laws in force in Victoria, and the Promoter and any consumer who participates in the Promotion submit to the non-exclusive jurisdiction of the courts of that State in respect of all matters arising out of or relating to these Terms, and the performance or subject matter of the Promotion.

Limitation of liability

  1. To the extent permitted by law, the Promoter (including its officers, employees and agents) will not be responsible for any acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical failures, security breaches, tampering, unauthorised intervention, fraud, computer viruses or other events beyond the Promoter’s control which affect the proper or reasonably anticipated conduct or administration of the Promotion, or prevent the awarding of the Prize in accordance with these Terms. If such an event occurs, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.
  2. Nothing in these Terms limits, excludes or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under any legislation in Australia. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury or any loss or damage (whether direct, indirect, special or consequential) arising in any way out of the Promotion, including but not limited to where such injury, loss or damage arises out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Prize value to that stated in these Terms; (e) any tax liability incurred by an entrant or a winner; (f) participation in the Promotion or any component of the Prize by an entrant or a winner; (g) the conduct, act or omission of any service provider or prize supplier associated with the Promotion; or (h) cancellation or postponement of any portion of the Prize for any reason beyond the reasonable control of the Promoter.
